Notice of Application Processing Periods

 

Delivery*, Distribution, Non-Volatile Manufacturing and Testing Lab Commercial Cannabis Activity Application Processing Period Opens on October 20, 2020 at 2:00 p.m.**

 

Pursuant to Los Angeles Municipal Code Sections 104.06.1(e)(2) and 104.06.1(f)(2), on Tuesday, October 20, 2020 at 2:00 p.m., the Department of Cannabis Regulation (DCR)  will begin accepting commercial cannabis license applications for delivery, distribution, non-volatile manufacturing and testing labs. Please note that, initially, delivery application processing  will be available only to previously verified Social Equity Applicants. Applications for distribution, non-volatile manufacturing and testing will be available to all interested Applicants. Information regarding how to be verified as a Social Equity Individual Applicant under the expanded eligibility verification criteria, pursuant to LAMC Section 104.20(b) will be provided at a later date this calendar year. Upon verification, eligible Applicants will be able to submit commercial cannabis license applications for delivery, as this processing period is indefinite. The application is only available online. Applicants are required to first complete the Pre-Application Review process and, after being deemed eligible for further processing for one or more license types, then required to complete the Temporary Approval process in order to receive temporary authorization to engage in commercial cannabis activity. Applicants can prepare for both the Pre-Application Review process and Temporary Approval process ahead of time by visiting DCR’s website to review related Application Procedures and Resources. 

The application is only available online. Click here to access the DCR online portal (Accela). 

*”Delivery” means “Type 9 - Non-Storefront Retailer” activity as defined in LAMC Section 104.02(a)(1). 

**The “application processing period” refers to the date and time that applicants will be able to access application(s) on the DCR online portal (Accela) based on a universal clock maintained by Accela. Applicants will be able to log-in to the portal prior to the application processing period.

Notice of License Application Status

DCR will provide notice to the public at various stages in the application process as required in the Article 4 Chapter X of the Los Angeles Municipal Code. 

Local law requires the following: 

  • Notice of Public Convenience or Necessity (PCN) Application Filing
  • Notice of Complete Application* 
  • Notice of Community Meeting* 
  • Notice of Cannabis Regulation Commission Public Hearing* 
  • Notice to Interested Parties 

*Refers to Notice Required During the Annual Licensing Process

Whenever notice is required, the Applicant shall bear the cost of mailing and posting of the notice in accordance with the mailing procedures in the Rules and Regulations and the applicable notice fees in Los Angeles Municipal Code (LAMC) Section 104.19(d). There are three types of public notice, each specified in LAMC Section 104.05.

Written Notice

This notice is posted on DCR’s website and sent via email to: 

  • The closest neighborhood council; 
  • The business improvement district, if applicable; 
  • The City Council Office within which the Business Premises is situated. 

Written Notice is required within 10 days of DCR’s determination that an application is complete and within 10 days of DCR transmitting an applicant’s PCN request to the City Clerk.

Mailed Notice

This notice is posted on DCR’s website and sent by U.S. mail to: 

  • The Applicant; 
  • The Applicant’s authorized agents or representatives; 
  • The owner(s) listed on the Application;
  • The owners and occupants of all property within 500 feet of the property line of the lot on which the subject Business Premises is located. For the purpose of notification of property owners, the last known name and address of owners as shown on the records of the City Engineer or the records of the County Assessor shall be used. For occupants, the notice shall be addressed to “occupant” and mailed to all property addresses within the 500-foot radius. Where all property within the 500-foot radius is under the same ownership as the Business Premises, the owners of all property that adjoins that ownership, or is separated from it only by a street, alley, public right-of way or other easement, shall also be notified as set forth above. 

The same notice shall be sent via e-mail to:        

  • The closest neighborhood council;
  • The business improvement district, if applicable; and 
  • The City Council Office within which the Business Premises is situated. 

Mailed Notice is required no less than 20 days prior to the date of any community meeting, as required by LAMC Section 104.04, and no less than 20 days prior to the date of any Cannabis Regulation Commission meeting as required by LAMC Section 104.06.

Posted Notice

The Applicant is responsible for posting this notice in a conspicuous place on the Business Premises. The notice is provided by DCR electronically and printed by the Applicant on a minimum of 11” x 17” paper size with a minimum 20 font size. The notice shall be posted immediately upon receipt from DCR. 

Posted Notice is required to be posted prior to the date of any community meeting, as required by LAMC Section 104.04, and prior to the date of any Cannabis Regulation Commission meeting, as required by LAMC Section 104.06.

Notice of Complete Application Determination for Annual Licensing Applications

The following Applications were deemed completed for the Retail Storefront Commercial Cannabis Activity as part of the Annual Licensing Process.


Notice of Public Convenience or Necessity (PCN) Application Filing

The following Applicants have requested that the City Council consider a request for a finding of Public Convenience or Necessity for Retail Storefront Commercial Cannabis Activity.  
 

Stakeholders or the general public may submit any comments and/or documents to the City Council pertaining to the request at: LACouncilComment.com

Additional information, such as the Neighborhood Council District, local LAPD Area Station, and other geographic service areas around the proposed Business Premises can be found here: https://neighborhoodinfo.lacity.org/  

**To receive updates about the Committee or City Council meeting where the PCN requests will be considered, subscribe to the Council File:

  1. Go to lacouncilfile.com
  2. Input the CF number in the search field and  click Search. The search results will appear on the right side of the screen.
  3. Click on the CF number to open the file.
  4. On the CF page, click on the envelope icon with a purple arrow at the top of the screen to subscribe via email.
  5. Enter the email address where the notifications should be sent.
  6. Click Subscribe.  A confirmation request will be sent to the email entered.  
  7. Go to the email inbox and verify the subscription to the Council File.
